Esso™ MyMiniFactory - Competition Terms and Conditions

SUMMARY

To make your life easier we have provided a quick summary of terms. However please be sure to read through the full terms and conditions below before submitting. We are not looking to catch you out, this is just a formality.

The uploader's submission is their own original design, for which they hold all related IP.

The competition is only open to users who reside in the EU, North America or Australia.

The uploader is above the age of 18.

You cannot enter if you work at MyMiniFactory or Esso.

You agree that Esso and MyMiniFactory may share your design (with attribution) for promotional purposes).

The main prize winner will have to agree additional terms with esso around the use of their design, to be eligible to receive the prize.

Entries must be submitted within the competition date, and brief parameters.

TERMS OF ENTRY

1. Information on how to enter and prizes form part of these Terms and Conditions. By submitting a Competition entry, entrants agree to be bound by these Terms and Conditions.
2. The Competition is run by MyMiniFactory (“MyMiniFactory”) and is open to residents of the EU, North America and Australia, aged 18 years or over at the time of entry, except;
   1. Employees, contractors, officers and directors of the Sponsor and its respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, advertising and promotional agencies, and any other individuals engaged in the development, production, printing, distribution or execution of this Competition;
   2. Members of the immediate families or households of those persons listed at 2.1 above.
3. By entering the Competition, entrants confirm that they are eligible to do so. The Sponsor may require entrants to provide proof that they are eligible to enter the competition.
4. The Competition will begin on 15 January 2018 at 00:00 and will end at 00:00 hours on the 14th February 2018. The web server (based in UK British Summer time (BST)) is the official clock/time keeper for this Competition. Entrants can enter between the above dates, after which time no further entries will be accepted.
5. To enter the Competition, an entrant must submit an original 3D printable design, (with the uploader owning all attributed IP for their design submission) to the brief described on the competition page. MyMiniFactory and Esso reserves the right to reject entries that do not fit the above parameters.
6. Multiple entries may be submitted by the same designer.
7. Successful entrants will be displayed on an Esso community library hosted on MyMinFactory (subject to confirmation of eligibility). Prize winners will be selected by a panel of judges from MyMiniFactory and Esso. All successfully submitted and approved designs may be shared by MyMiniFactory and Esso for promotional purposes. Additionally, the main prize winner will have to agree terms with Esso for use of their winning design to be eligible to receive the prize.
8. MyMiniFactory will make all reasonable efforts to contact the winners. If a winner does not respond within 14 calendar days of being contacted by the Sponsor for the purpose of arranging the prize or does not provide the name, age and photo ID for themselves and their guest within 14 calendar days of being notified of their win (where applicable), MyMiniFactory reserves the right to select an alternative winner.
9. No responsibility can be accepted for entries that are received after the Closing Date. The Sponsor will not be responsible for entries that are submitted incorrectly, or that are lost due to equipment failure, technical malfunction or similar. Proof of submission online does not constitute proof of eligibility for a prize.

11. The grand prize winner will receive the latest BCN Sigmax 3D printer supplied by MyMiniFactory on behalf of BCN3D, to whom any performance issues or claims arising through use of this printer should be directed.
12. The runner-up will receive a Startt printer supplied by MyMiniFactory, to whom any performance issues or claims arising through use of this printer should be directed.
13. No cash or credit alternatives will be offered in lieu of the prize(s). If a prize is not available for whatever reason, MyMiniFactory reserves the right to provide a substitute prize of equivalent value. The prizes are not transferable. Prizes will be shipped by BCN3D and MyMiniFactory to the winners.
14. MyMiniFactory will send the name and county of the winners to anyone who writes to it within one month after the Closing Date of the competition requesting details of the winners and enclosing a self-addressed envelope.
15. By taking part in this Competition, entrants agree to the fullest extent permitted by law to release, discharge and hold harmless MyMiniFactory and Esso, their respective parents, affiliates, subsidiaries, retailers, distributors, agents and suppliers engaged in this Competition, and the respective directors, officers, agents and employees of the foregoing (collectively, the “Released Parties”) from any liability, claims, loss, damage, personal injury or death arising out of, or relating to, entrants’ participation in this Competition and the acceptance, use, misuse or possession of any of the prizes. The foregoing should not be taken as an attempt to limit or exclude liability for death or personal injury caused by the negligence of the Released Parties. The Released Parties assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, unauthorized access to, or alterations of entries, and reserve the right to take any action that may be available. Entrants’ statutory rights are not affected.
16. MyMiniFactory will never disclose an entrant’s personal details to any company outside the MyMiniFactory group of companies for them to use for their mailing or marketing purposes, except for the aforementioned sponsors; Esso Petroleum Company, Limited, registered in The United Kingdom and BCN3D Technologies © 2017 registered in Spain. MyMiniFactory will only use an entrant’s personal details to contact them if they have won a prize, for the purposes of the Competition (including publication of the names of winners as outlined above) and to administer the prizes. By entering this Competition entrants agree to their personal data being held and processed. You mave remove your data at any time by deleting your MyMiniFactory profile. 17. MyMiniFactory reserves the right to cancel, suspend or change the Competition at any stage where it becomes necessary to do so. For the avoidance of doubt, cancellation, termination or suspension by MyMiniFactory of this Competition shall not entitle an entrant to any claim or compensation.
18. MyMiniFactory reserves the right, at its sole discretion, to disqualify an entrant which it considers has not acted in accordance with these Terms and Conditions, the spirit of the Competition, for any unfair or unlawful conduct, or if failure to do so would result in MyMiniFactory or Esso or any of their group companies failing to comply with the law. Any breach of these terms and conditions by the winners may lead to forfeiture of their prize. The decisions of MyMiniFactory shall be final and binding in all matters.
19. These Terms and Conditions are governed by English law. English courts will have exclusive jurisdiction over any dispute relating to or arising from the Terms and Conditions or this competition.
